Agreed that this will throw out all the crappy body shoppers. This is what we need in future not to make it difficult for future h1-b or other people. We should infact support this bill as this will weed out many Indian Body shoppers and benefit everyone.
This is nothing new but most of it is just implementing what is already in low. Thats my take on it.

In ac21 law; it doesn't say anything about the scenario if 140 is revoked by employer. It is totally silent to it.
AFAIK:
AC21 is not a law, just a guidance. Assume an immigration case goes to court hearing, the judge would completely ignore AC21 guidelines. Any employment per AC21 will be considered unlawful in this case. The probability of a case going to court is not very common though.
The above is just FYI.. You can google for more info.

As per our lawyers, right now USCIS is in the process of entering our applications in their system (for date of receipt and such). There was a memo from USCIS saying that they will be done with the job of data entry by August 1.
From August 1, we can expect either rejection or acceptance of the actual application. The hope is that a court/congressional intervention before August 1 will change the USCIS action of rejection into acceptance.

I am already financially/emotionally drained out due to my accident. I guess its going to be deja-vu for me again.
Now I have hardly any money in my bank accounts(around 14K to be precise), and no house , which seems to be a good news and they cannot rip off much.
Only questions I have now are:
1. Any idea generally how long these things can go on?
2. During the trial will there be any restrictions on leaving the country (In genuine emergency situations)?
3. In the worst case if I am willing to give-up my GC..would it still make sense for us(my spouse and 2 kids) to go thru all this emotional stress all over again by staying here and thinkign about what will happen tomorrow...?
If you have only 14k then that is all that they can claim from you. In extreme cases they can consider put a lien against your future pay (for eg: 50% of future pay going to pay for the damages).
But don't worry so much!!! Why you will ask? here are the reasons.
Firstly, it matter who is suing you. Are the lawyers representing the insurance companies of the victims or are the lawyer retained by the victims directly.
If the lawyers are retained by the victims directly, the victim has to pay the lawyer to fight this case. The lawyer will only fight if there is way they can get you to pay the fees. The fees for such a lawsuit will far exceed 14K!!! So what you might want to do is request a lawyer to write a letter on your behalf to the lawyers of the victims and request them to settle out of court. for may 10K or else threaten that you will leave the country and they will recieve nothing!!. Ofcourse you don't have to leave the country you are using this as a barganing chip. Move the 14k to india in your parents or sibling's name. that way when they do an asset check nothing shows up.
From your posts you are sounding very stressed!! don't be relax you don't have to give up your GC. You have get a lawyer to help you out and pre-empt this before it goes to trial. Even after it goes to trial get a lawyer and fight for this (provided it does not cost you more than 14K). If you or your wife or kids are in university, most universities have laywers who will give free advice to students. You can also choose to pay between $100-$500 for consulation with other lawyers (remember the lawyers you are going to consult also want to make money so they will push you to retain them and some of them will scare you with the most unlikely scenarios. Filter this out by talking to 4-5 different lawyers).
G'luck. this is not the end of the world and frivilous lawsuits in the US are more common than legitimate lawsuits. This is not worth your sleep! Fight for this and don't think about giving up your GC for this!

Thanks for all the replies! I already contribute to IV, so all the mails about contributing to IV can stop :) You dont need to sell me IV.
I am considering an opportunity, but if I leave I might lose my PD as my current employer does withdraw the I140.

One thing I have noticed, if you want to transfer money and if the dollar value is coming down a few cents, they hold on to the transfer and transfer the money after 10 to 12 days, this is irritating if you have some emergency out there and want to transfer money fast.

Profile just displays Labor approval date, not application date. But interesting observation. Some have approval date of Nov 2002 -- so very possible that their PD is much earlier.

I believe once you use your AP for travel , you automatically comes EAD. If you are working for same employer with H1, then employer may have to inform uscis above status change (no big deal . i don't know if all employers are doing that) i don't think you can transfer your H1 after travelling on your AP. If you want to be in H1 status again all you have to do is leave country , get H1 stamped if expired and come back again. You will be in H1 status.

You make these H1-Bs who have spent 6 years here (working on various products, technologies, ramping up, understanding customers, relationships etc) go back, they are going to start companies in India. Now all the capital stays out there. The same 5 products that could have been built in the US and sold to lots of companies abroad, will now have to be bought by the US.

In case If I wanted to have my attorney, I need to cough up $275/hr and 5K check upfront and he feels his fee may add upto 10K by the end of all this. So not sure whether just go with insurance agent's attorney for the time being and just wait how it goes, even if the case goes against me as I don't have much bank balance etc I am not sure what they can get out of me..

If I were in your place, I would not spend money to hire my own attorney- not yet. I would let the insurance attorney handle the initial few months, and only after things start happening, I'd think about paying an attorney myself. Meanwhile, use this interim period to look for a very good attorney- meet with a couple of them and decide which one would you choose, if you had to. Personal liability defense is handled best by firms specialized in tort defense (eg. who defend medical malpractise suits), and NOT by trial lawyers who are mostly experienced with plaintiff's cases.
Another thing, since YOU were the one who seems to have experienced most injuries in the accident, didn't you get letters from trial lawyers offering to sue the other folks and ask for damages (since THEY were at least 20% responsible for your injuries)? Such trial lawyers do not take any money from you upfront- they only take a % of the money recovered. This might make things too messy for you to handle- but give it a thought; sometimes offense is the best defence.
Some folks have advised you to move money etc out of this country- but remember this can backfire. Any financial transaction you do now, will be heavily scrutinized if there is a trial and will be treated as fraud if they are seen as attempts to hide money. This will bring in additional charges and the court will order for reversal of all these transactions. So tread carefully, my friend.

I am not working in permanent job. I am also in consulting job. I am not supporting the restrictions. I am giving comments. Some comments were not liked by some IV members and they are suspecting that I am anti immigrant from alipac or numbersusa. But I strongly suspect Indian bodyshoppers and consulting companies used big portion of H1bs, and that might be reason for those restrictions. Till 3 months before everything was going well and all of IV provisions were there in the skil bill and strive. But suddenly Durbin bill was introduced and just a few weeks back they sent a notice to Top most Indian companies about H1b. Whatever reply Indian companies give may create more trouble.So something went terriably wrong in past 3 months. Not even one pro legal immigrant amendment in Senate. I am not seeing anyone working seriously except IV. Immigration lawyers are more bothered about point system and family based immigration system.

btw i have a job like the one i described above, but preaching does not come naturally to all of us i guess.
