    I was seeing lot of posts in this forum about reverse brain drain, so I wanted to comeup with a question which would answer my question without doubt.
    I wanted to see if all those who are in the GC queue and think that they are a very important for America and insist on that in their signature by saying "Help us stop reverse brain drain" are really meaning what they say.

    I beleive if we are so much in demand we can get a job in another country and have similar quality of life or better. So only poeple who are confident of the reverse brain drain and America should stop it will not hesitate to vote "Yes" if they are so frustated with the GC wait times.

    Once again thanks to everyone who so far particiapted in this poll and posted comments.

    Some people have given me negative reps for this poll saying it is useless but never say why "they" think it is useless. I would appreciate if you can post your opinion with those negative reps. Offcourse postive reps can be without opinon :D

    Anything you could contribute is great, but yeah passing on the message and encouraging others to contribute will be most helpful and that will generate more contributions.

    I haven't seen any other movement as big as this and as productive and valuable as IV core team is doing for immigration community.

    I hope other members will recognize this and donate generously.

    Friends,
    I too have received an update from CRIS about reopening my old H1B from my previous employer which is a large multi-national organization. I have changed the company since then and I have already received my EAD with the new company. I am a bit worried about the outcome of this review. If in the event of revoking the H1b of my previous employer, will my current H1B will also be revoked or am I safe irrespective of the outcome. Would really appreciate if someone can provide any feedback.

    With my very best wishes to those of you waiting for your GC, this thread is created for the lucky among us who received it recently. I am putting together a list of things to do, and not do, to maintain our freshly minted PR status, which should also help during future citizenship application. The list is mostly about little things that others have learned from experience (and I am learning from their experience, by reading in immigration-related forums such as IV).     I have a unique situation here. My original GC sponsor (a multi billion dollar industry leader) laid me off after 6 months of I485 due to lack of position in the company.

    I ported my GC using AC 21 and joined another small consulting company. Now my GC is approved and I have an offer in hand from another company.

    Will it be a good idea to move or do I have to wait for 6 months or 1 year before I make an employment switch.

    My most important consideration is that there is chance of potential loss of job (may god forbid) with the current position. I may be able to save myself by switiching job right now. And of course there is more money on the table.

    May be that is the reason you took offense when people commented on Bcom thing. An MBA is valuable only if your bachelors degree is valuable. Many people have this wrong notion that it does not matter what you have in your bachelors, if you get an MBA everything is all set. Companies need engineer + MBA combination. Very few companies hire MBAs for accounting work. DOn't confuse accounting with finance, they are different. I can tell you that for sure, as i work in finance.

    Contents of MBA also matter, most people take easy way out by taking all bluff management, marketing and strategy courses. Very few take the hardcore finance courses such as derivatives, fixed income, and valuations (these courses could differ in level of difficulty based on school).

    Can someone please give a GC immediately to getgreensoon1 so that he can get off this forum for good and not talk BS anymore :D

    Faulty Immigration Policy (FIP) : I am mighty FIP, I am going to decrease the H1 quota.

    Industry : Okay , well, what can I do :( , Well !! If worker can't come to work.... How about send the work to the worker ?? :) ...Outsource !!!

    Indian IT companies (IIC): We are glad to do the work. We have enough resources to ramp up and ramp down. we can send people on L1

    Things are going well for a while ....

    FIP : How dare they use L1s, I will make it very difficult to them. From now on L1 is tightened...Hehehehehe:D

    IIC: Okay I need people to go to US for knowledge transfer, understand the requirements and implement S/W , let me apply H1s enmasse.... else I may not get a chance..

    FIP : Errr , They are using all my H1s , let me tighten H1s even more, How about I charge $10000 for each person coming in. This must teach them (IICs and those out sourcing) a lesson.

    Industry : I cant find any body here, and it is expensive even to continue my employees who are on H1. I need to off shore more work. Hey IIC , I need some one here for understanding my requirements.

    IIC: Sorry sir, I cant send any one to US because it costs me $10K to begin with , and even if you are willing to pay that , there are no visas to any one. Gates of US are closed.

    Industry: Okay I will send Bill, Dave , Frank and Amy who are our business analysts and managers to India for a month, they will walk you through the requirements and come back again for testing.

    IIC: Okay , Indian Govt will be glad to give them visas.

    India : Good, Instead of my sons going to US and spend all their money there on cars, houses etc, they will earn here and spend here. Other industries are happy too :)

    Many years later .....

    Bill : Amy, we should get there quickly , there are big lines at Indian consulate. Hope we can get in today.

    Masti_guy - Don't worry about not having an MS. If people with MS move out of the queue the queue will autmatically move forward. There are a number of MS engineers working in EB3 positions especially the one who have never changed employers after they got out of school..

    Here are my case details as well.

    Came to US in Aug 1999 on F-1 after B.Tech. Graduated with MS (Telecom) in Dec 2000. Joined a major telecom firm immediately after graduation. My first EB-3 labor was filed in Dec 2001 (Non-RIR) but employer withdrew it because of lay-offs. Employer filed again in Nov'03 (Non-RIR again) and it was approved in March 2007 (after RIR conversion in Jan 2007) by Dallas BEC, followed by I-140 approval (March 2007) and I-485 filing in July 2007. Though my job required a MS degree, my employer could not file in EB-2 as there were people in my team with just Bachelors degree when they joined the company 10-15 yrs ago and lawyer did not advise employer to file in EB-2 as EB-3 was current those days......After surviving 12 rounds of lay-offs, no job security whatsoever throughout and fed up with EB3 process, I changed jobs after 8.5 yrs (July 2009) and my new job required a minimum of MS + 6 yrs of experience and fortunately my new employer (another large company) had no issues re-starting the process again. I work in Mobile Communications R&D (developing networks which support smart phones (2G/3G and now 4G-LTE technology) have been in this field since Jan 2001) and here are my EB-2 case details:

    Joined new employer in July 2009
    PERM Prep work took 6 months
    EB2 PERM filed: March 30th, 2010 (MS + 6 yrs or BS + 8 yrs as min requirements)
    EB2 PERM approved: Aug 11th, 2010
    EB2 I-140 filed: Aug 27th, 2010 (Premium Processing, EB3 I-140 approval copy enclosed with request to Port EB3 PD)
    EB2 I-140 and I-485 approved concurrently on Sep 3rd, 2010
    Cards received Sep 7th, 2010

    jsb - I received an email today from CRIS that they have issued an RFE on my I-485. I am EB-3 India September 7, 2007 I-485 filer with a PD of June-2005. Like you said, they do not consider country of chargeability until the case is all set to approve.
    Otherwise, why would they touch a EB3-I case with PD of 2005.

    I am not sure what are they looking for in FRE. I want to get out of this game now....one way or the other!


    "EB Applications pending from India" is very vague, and most probably is not what we are looking for.

    USCIS has indicated earlier that they don't know chargeability country until application is ready for approval, which may be true although we didn't want to believe this. Most likely until 485 application is approved birth country is not written anywhere other than the paper application. In most 485 application cases (family, EB and others), chargeability country is a just a matter of recording at approval time. At final approval time, when birth country is found to be retrogressed, application goes back to pending (or cold storage), but ready to approve. This also explains why cutoff dates have to rely purely on guess work, and move back and forth.

    For proper handling of cases for retrogressed countries, USCIS/DOS really have no workable method in place.

    I am not referring to the hypothetical scenarios and assumptions.

    I am talking about the real scenarios in past that were covered. Did you have the first hand experience of it being covered?

    I have bought it twice for my parents but did not use it (thank god). Yes that's a hypothetical scenario but I went through the policy fine print. At least it offers to cover some part of preexisting conditions which other plans do not.

    $50 is too high. I know big communication American company who bring people here on $35 per day. That is even below the minimum wages.

    I know even Accenture brings people on B1 visa @ 50 dollars a day
