D. INDIA EMPLOYMENT SECOND PREFERENCE VISA AVAILABILITY
Section 202(a)(5) of the Immigration and Nationality Act provides that if total demand will be insufficient to use all available numbers in a particular Employment preference category in a calendar quarter, then the unused numbers may be made available without regard to the annual �per-country� limit. It has been determined that based on the current level of demand being received, primarily by Citizenship and Immigration Services Offices, there would be otherwise unused numbers in the Employment Second preference category. As a result, numbers have once again become available to the India Employment Second preference category. The rate of number use in the Employment Second preference category will continue to be monitored, and it may be necessary to make adjustments should the level of demand increase substantially.
May be EB2 India and China can see some movement in July VB published in June.
This piece in VB is telling that the unused numbers in EB2 will be given to the retrogressed countries in EB2. The VB when it defines the categories, also defines EB2 as 27.6% of 140K and what ever is left over from EB1. EB1 is current for some time now and EB1 also circularly gets unused numbers from EB-4 and 5 which account for around 20K. I have been under the assumption that EB-3 ROW must become current for EB-2 retrogressed countries to move significantly forward because of spill over and not by the quota they get every quarter. I believe it will be the same old story. They will wait till last quarter and then will waste thousands of visa numbers because of their darn slow processing hands and we people will again start talking optimism from Oct 2010.
What happened to the IV's talk with USCICS on spillover policies? Does anybody know?

I know the post was entirely wrong and foolish.
But I feel that I am in the dark about IV activities for the past one year.
I am one of the silent IV Supporters and long time (from the beginning) monthly contributing IV Member.
It would be better to have a special thread/monthly bulleting page from IV to tell the members to know about IV activities or progress.
After the last year July fiasco issue I have not seen any posting about IV activities on the web site other than lot of threads and could not able to figure out the work IV is exactly doing.
I strongly believe because of IV core team only we were able to come through successful in July 2007 Bulletin issue. But do not know what else is IV doing for the past 12 months.
The Flowers, Letters and Phone Calls is not working as we expect. I do not know about other activities other than sending letters and phones during every congress session.
I believe IV need to do some thing different. There is no media reports about legal immigration issue (not for IV) for the past one year.
My perspective is that we need to find a way that Media and Public will aware of the issues we face every day.
I am not questioning the IV Core Team. It would be great if the IV members know some details about IV activities every month in a bulletin or thread etc.

If a new H1B visa application does not run against the regular quota, I don't think he has to wait till Oct. When my H1B got approved (under quota), I started in 2 months - February in my case.

CIS awhile back reported that they only have 60K I140 applications pending. So 125K I140 applications can't be pending..
My understanding is VSC and CSC are working on H1B and NSC and TSC work on I140, I485s.

I'm not writing this in my capacity as a core member, but just as a regular individual. Aman has selflessly worked towards EB immigration reform, at the cost of precious personal time with family, as well as taking vacation time in order to make the numerous trips to Washington DC. He has not asked for reimbursement for expenses incurred during numerous previous trips to DC.
The skilled professional community, those who are members of IV, and those aren't yet, must be extremely grateful to Aman for this selfless act.

Several volunteers have spent hundreds of dollars out of their own pockets without disturbing IV funds for press releases, travel and so on.
One important thing: Money is an enabler for several things including operating expenses, infrastructure mobilization, etc., However, at the end of the day, solidarity and efforts count.
While IV will continue to require funds, members are encouraged to assist in other non-monetary ways as well. That would be even more powerful information for us when we get in touch with policy influencers. A recent example was the stories requested by Cong. Loefgren's office, for which we had to prepare several stories, requring us to get in touch with you all. Completed information will help easen this process
a) Please discard your cloaks of anonymity and complete your profiles with your information. That's the first step.
b) The next step is to increase awareness among the community, law makers and influencers.
c) Get more members to enroll.
d) Assist in non-monetary ways: How many of you have non-working spouses, friends, et al who can contribute focused time and effort(not money). In other words, volunteer time and effort?

leave my indian employer soon. they are saying they have 90 days notice period.... which was set from india. I work in ohio which has "employment at will" law... I am not going to serve the full notice period..... but if they deduct any money..... I know many people are going to blast me and curse for after reading my post but I think NEw H1b , greencard applicaitons , or any other route that leads to GC should be banned for countries that are severly retrogressed in EB category ...same for the FB based new applications....Doesn;t make sense..one side US business needs H1s so they fight to get it in thier favor but on other side the life of these H1b / L1/L2 guys becomes miserable the moment they get in the GC line.....

If labor substitution, applying 140 in 45 days etc.. are the kind of rules that are being framed, it is mainly because all the companies started exploiting these rules.
It can be hypocratically argued that Desi companies only sell labor and misuse it, but from a larger perspective, any company including those multibillion dollar companies may actually misuse labors ie like HR will use sub labor for friend, lawyer may educate HR about the loophole and they will use it as a card for new hires. If such a thing is stopped there is no room for misuse of any form. We have to thank Desi companies because in someway, by totally exploiting the loophole, they helped this cause.
45 days in filing 140. Believe me, such deadline is definitely achievable. 140 is a simple process and all that is needed is company audit and tax reports. I guess time will be given to those who already have labor certified and not applied for 140 for whatever reason.

I am thinking of starting a google group for people who would like to send letters to USCIS/White House for our efforts. Not sure if we already have IV, if we really need another google group but the main aim for doing this is to send reminders to us to send letters and once in a while have discussions on what affect our efforts are having. When can you file WOM? It's a grey area. When the Name Check has been pending for more than 2 years like in my situation, then you definitely have "a case". However, I have heard that some people do it after "only" one year.

Now the country limit rule applies only to EB3-I and EB3-C.
