From the article it seems Tancredo gives wrong information about H1b. Generally CNN is not responsible for any other person is giving wrong information in the interviews unless CNN accepts the information. Daily they are interviewing many people including Politicians and there is lot of chance for wrong information. Many persons gave wrong information about Iraq in CNN but CNN could not be responsible for that. If Lou Dobbs gives/accepts wrong information then we can complain about him in CNN. So if action needs to be taken we need to protest Tancredo for his comments.

I am sorry to hear about your case. Do not loose hope. I think it is a very common case in USA. You have achieved so may things in your life so far. You will not loose all of your hard earned money for such a normal case. I think, you should not hire a lawyer until you need to support yourself. Let the insurance company lawyer handle the case. Try to get all the information possible from company lawyer. And contact few lawyers personally & get advice. Keep the information, but do not hire. Hire a lawyer, when the company can not continue their lawyer any more.

Unfortunately, country of birth for PD determination is one thing that cannot change. It is ridiculous that a country like the US that promotes itself as a meritocracy and a country of second chances ties the fate of EB applicants to such an immutable parameter.
I used to believe in and respect the so-called the American Dream. The more I stay here, the more I see its hypocrosy. ;)

You're right. No offence but no authority seems to be listening to IV suggestions. I agree that people at IV are doing great job, but the problem is nobody is listening. They just don't care. And this think will go on & on. I remember s'body suggesting hunger strike and at that point of time I thought that won't work. But now it seems we have to go extreme and do hunger strike and stuff to pressurize this crappy system.
EB3 people don't think I am being selfish here. The truth is we have to work unitely and pressurize for visa recapture. That will be beneficial for e'body.
Lets target the 'Asses' asking for a kick. Let's all kick ass.

Yesterday, my sister in law entered USA from Newark Airport and she witnessed three people holding HIB visas get cancelled at the immigration point, one had EAD.

Except the native Indians, everybody in this country is an immigrant or a discendent of immigrants (and many of them illegal, btw, but they quickly forgot that...). But once they settle, the ex-immigrants immediately start putting hurdles before the new immigrants - laws of nature! Now we have: "Immigration is a privilege, not a right" :-) Come on!
Our case is a tricky one because we do not have enough leverage to push the government to resolve quickly the mess it created with the backlog and the retrogression.

More likely cause is that the letter from the applicant notifying his new job never reached/registered in CIS systems.
Did the person send the letter in time? Was there any intermediate change in status between NOID and actual denial status? This is crucial to know before jumping to conclusions.

Here is my case trail
worked with employer A from June 2005 on h1b visa.

Filed for i 485 in July 2008 never received FP notices

Employer A requested 140 revoke in August 2008.
Spouse got FP notice in August 2008 whereas I (primary) got NOID asking for new employment details.
Responded to NOID in a timely manner and on August 25th, 2008 - my status changed to "Response received - case processing resumed"
In Jan 2009 I got my FP notice.
In Jan 2009 - I travelled using AP and got back fine.
In March 2009 - I got a denial notice saying "485 is denied because 140 was revoked on August 2008. No appeal only MTR" - thisletter comes from a different officer id than the one who sent the NOID.
My question to UN and other gurus. Does it have anything to do with a changed interpretation? My lawyer says "This is a training issue - the new officer did not know about AC21 and as soon as he/she saw 140 as revoked - just ignored your other details on the case and issued a denial notice. This is very common and can be resolved using MTR"

This is how it works. If you file for your 485 now, the next thing that is expected from you is to wait for the receipt, that would take 3 to 4 weeks. Then you will get finger print notice, that might come in three months time. Once you are done with all this then check the processing date of the respective service centre where you have filed your 485 application.
Now coming to the question of unmarried filers, if the principal aplicant's date of marriage is beofe his or her 485 adjudication of adjustment of status, there are two ways principal applicant file for 485 for his or her spouse. The spouse can travel to US on H4 and file for 485 or the principal applicant can do consular processing. Now consular processing is good for those cases whosw w PD is current but since retrogression can kick in anytime it is better to travel to US on H4 and file for 485.
Another important aspect is if you file 485, EAD, Advance Parole and you use EAD, you loose your H1 status, hence on EAD you can not bring in your wife. So unmarried filersn it goes like thisn you go ahead and fileyour 485, then go to your home country brng in your wife on H4n as you have aleast s months of time if NSC, TSC or CSC 485 processing is not current and it is hown 1 month for receipt of 485, three months of time for getting the finger print notice and you can postpone by another month of FP by rescheduling it to another month. So literally you have 4 to 5 months to get married and by that time the dates will retrogress again. So dont worry, just go ahead file your 485 and start looking to get married. But try to bring in your spouse asap so that you can file for your spouses 485 also till the time PD is current. If you are not able to file for 485 for your spouse and you have filed for yourself and whenthe dates retrogresses again when your spouse comed to US you would not be able to use EAD as using EAD nullifies H1 and H4 status. So desi consulting companies will keep on sucking your blood as you cannot change job using EAD. i called a couple of times spoke to Inf officer at NSC ,
&& she told she was not aware of cases where NSC has created rejection letters and sent them also she added they just completed june filers and will be starting to proceed with JULY .
Now reg. my processing times:

Receipt Jul 2 9:54 : FedEx

Checks : Not cashed Yet

I never got any LUDs but got a denial on my 485 after going through the AC21/NOID stuff way back in August, 2008.
There could be some background processing going on.
Is there are pattern to these LUDs?
I am in a situation that the company where I am working is offering a permanent position and my employer is also willing to support me. But I am afraid of doing AC21 after reading about the pitfalls of AC21. Any suggestions??

Attorney Sent a Letter to AILA liason on 8/20
Called TSC on 8/27/ - Opened a SR
Called TSC again on 9/3 - CSR told me that they sent a reply for the SR opened on 8/27
Recd the SR - reply on 9/4/09 stating that " your Application processing is pending/delayed"
Called Senator office on 9/9/09 and sent fax
Called Senator office on 9/14/09 - Liason officer told me that it will take 30 to 60 days to get the response.
Called other Senator office on 9/14/09 , Sent the fax
Called again to II Senator office on 9/15/09, I was told to call back after 15 days to get the respose
Called TSC again on 9/15/09 around 4.45 PM EDT, Talked CSR , So nice , she eve discussed about the weather , summer time events etc, I told her about the letter I have recd for my SR ( 8/29), she asked if it mentioned any time frame, And i told her "No", then she said it is very unusaul and tranferred my call to the officer,
1st he told me the current processing time is 9/07/07 and my ND is 9/28/07 so my application has a 21 days lag, Then I told him that my application has mailed on 8/7/09, I also mentioned about the letter i received for SR, then he started asking questions about the receipt # and case details
The the officer verified following details
My first name,
Last name,
Address, Zip code, Door #,
fathers first name
mothers first name,
4 Digit SSN
and then told me that your case is under review with an officer from 8/29/08( Then I realized both of us had a Soft LUD on our application on 8/29/08) , I told him about that, the he said yes it is , it is related to the interal process. Then I asked him that What can i do now, He said, Keep your faith and finger crossed asked to me keep on calling USCIS TSC office every week to check about my case.
I really don't know whether he is playing with me or what.

2. I did not use the p.o box as fedex did not accept the po boxes. But later i found out that its better to insert the po box also. I was curious if my reached the proper address at all or not.

Can you confirm 2 things for me please.
1. The date you application was received at NSC.(Mine was recived on 2nd jul @ 10 51 am)
