EB3 I is bad and will get worse. EB 3 ROW will also get screwed big time because of the 300k namecheck victims who are now eligible for visas. Trickle down will also be impacted because of that. USCIS uses short sighted methods to clear their hurdles, they dont realize that there is person behind each visa number. The only thing certain for EB 3 is that in OCT EB 3 will revert back to the June 08 dates.
The sad fact is that most of us were screwed because the lawyers suggested to our companies that EB3 is easier to process than EB2.

I am married too, but i only said that there are other easier paths aswell.
Regarding working late, i am a fulltime employee with H1-B and never came to office before 10:00AM and stayed after 6:00PM and never ever worked weekends. Mine can be an exceptional case, but what iam saying is, your relationship with your manager is important. This can make a lot of difference in your lives.
As long as you deliver what is expected of you, you can even work 4 days a week and get paid for 40 hrs per week.
I don't know, if we are deviating from our main discussion agenda started by LogicLife.

I disagree with Logiclife on immigration to the U.S( or to any other country for that matter) being a right. All that would have made sense when the "new world" was discovered and does not hold any water in today's context.
Also, we get paid for getting the job done not working hard. So just a claim of being the most hardworking "class" of prospective immigrants will not cut it.

If USCIS is approving H1B/L1 applications, for any Software job, with a B.Com or B.A degree, then defenitely, it's a high time for it to change the rules for the H1B educational qualifications. I don't mind to port to EB1, if its accepting online degress, by getting a Ph.d deegree from a tri valley online university :D.

The Pediatrician told us that she should not take the vaccince based on the manufacturer's literature. They gave us a letter to that effect and the Civil Curgeon then applied for a blanket waiver.

I-485 is mostly about the eligibility of the individual (like medical, illegal presence, fraud etc.) and so getting rejected at I-485 stage is not that common (especially after the approval of the underlying immigration petition). And if it does get rejected, more often than not, the individual may never be eligible for permanent residence due to the same reason. So usefulness of H1-B as back-up is of very limited narure.

-- Involved in a collision few months back. As I had rear ended the vehicle, as per the investigation, it was found it was my fault(80% mine - 20% others)
-- Now after more than 18 months, I get a law suit for 3.25 million dollars(. This was served against ppl who were involved. Right now my I have my EAD and AP and maintaining H1 status.
So what are my options now?
1. Check with attorney and start defending..?
2. pack the bags and go back to my country ? If so, will there be any issues in coming back again, say after 3,4 years?
3. What about my GC?
Any help would be greatly appreciated and I guess it would be a biggest decision of my life ..

The reason why Asia has less is that people from India and China are not eligible to participate in GC lottery.
So to be fair, they should remove 7% cap per country from EB based.

i will go ahead and give my take on this based on my experience
1) some doctors DO NOT give a waiver since they think its OK to take a TB test during pregnancy itself, let alone not taking after child birth. so call the doc b4 you go.
2) I believe as long as the doctor gives you a blanket waiver it should be fine, thats all the proof you probably mifght need..
I dont think USCIS is so crude to go into getting excruciating evidence in these type of situations...good luck;)

you can add your spouses before an I-485 is approved. Once its approved, then you are in trouble. These dates are current only temporarily, and retrogression ("severe" as per the bulletin) is expected again soon. So go ahead and file your I-485 right now if your PD is 'late' (2006 or so) you will probably be on EAD/AP for a while.
if your PD is 2003/2004/2005, then as soon as 485 filing is done, start looking for your life partner :)

I only knew of this movement today after reading the Washington Post. I will start contributing for now. I will do it gradually. I will also try spread the news to all people I knew who are also victims of the Visa Retrogression.
