Using H1B makes one safe. but how many years we want to do the safe job. If I-485 gets denied do u have enough patiences to file another green card. One thing is believe is "We are here to make money, most of us are in our thirties and we have short time remaining to reach our goals. I think we all have one year EAD. wait for 6 months then go on job hopping, learn whatever you can, get into whatever you want. Start a business, do something.... Anything you do will help you in future. Sitting with H1B in pocket may take 4 years cream of your life.
If you have the talent you can get great salaries anywhere in the world. Because of your talents and hard work you guys are here. World is not small.
I will use EAD soon.

Moderators, do you think it's possible to issue an email receipt to contributors? I donated $250 so far and the first $100 was done through my bank billpay.. However, the online billpay deducted the amount right away, and it didn't give me any indication whether the check was actually endorsed by the intended recipient on the supposed delivery date.. Worrying about that, I sent in my second contribution via paypal.
Writing an actual paper check, I would see a copy of endorsement online, or using paypal I would know it's cashed out via email. But this is not the case with my bank's (bank of america) online billpay. Thanks!

EB3 I is still very unfortunate... I guess this is how the melting pot works... correct me if I am wrong.
Out of 140K Visas 7%= 9800 is assigned to India (All Categories)
Out of 9800 - First EB1 then left over EB2 and Then leftover to EB3 :(
From over all left over of 140K - First EB1 then left over EB2 and Then leftover to EB3 (all other countries) - Left over (EB3 China) - Left over to (EB3 India) :(
EB3 India is lowest on the FOOD Chain!!!
EB3 India is not unlucky but thats the default category for any one to apply when they or job doesn't let them go for Eb1/2.
So the obvious reason is:
when we have brand new lot of 85K H1s most of them apply for Eb3, and big chuck is Indian (no 7% cap here), but regardless of category, if 85k applies for GC, with one dependent it counts 130k.
And for GC allocation we have country cap which is ONLY 7% when we have 70% applicants. Do the math, 85000*.7*2= 119000 applicants for GC from India each year and they are entitled for 140000*.07=9800 and now lets say with all favors from ROW and EB1 we got double say about 20,000 still there is a back log of about 100K each year.
Thats assuming everybody applies for GC out of 85K H1 stock.

good thread. I do little bit of trading myself from a personal brokerage account and made some pocket change (few hundreds by trading commodity ETFs) recently. in layman terms, can u explain wht do u mean by ' US natural gas market is in contango' .
First of all note that the original post was alomst year and a half old so dont go by the ideas there now :D
In commodity markets you trade futures and spot. Spot means immidate delivery of the under lying commodity. In futures you pay today for delivery at a future date. So typically the price of the future will be the price of spot + the storage charge (simple calculation to give you an idea considering no premiums). As the day of delivery approaches the price will pull to spot price. For example if west texas intermediate (WTI) crude is $92 spot price the 3 month future will be $100. (92+8 for storage). Considering that the spot price does not change at all, in three months time the price of the oil you will now be purchasing will be $92, but you paid $100 for it. This is backwardation. This is usually how markets are most of the time.
Now if in 3 months the price of WTI is trading at $110, you will own oil you paid $100 for and now can turn around and sell for $110. This is contango.
When you buy a commodity ETF, they dont take actual delivery of the product, they roll their contarcts. So they will hold a 3 month contarct and when the third month approaches they sell the contarct and get another 3 month contaract. If market is in backwardation then they will always be buying high and selling low. If market is in contango they will make money but as soon as it switches back to backwardation they will ride down the slide and loose all the money they made. So I dont think ETF's are agood way of making money in commodities passively. You can actively manage the ETF portfolio and make money using options and hedges and leveraged ETF's. But buy and hold, I suggest go and invest with a CTA who will be trading rule based to negate the effects of contango and backwardation.

Just did a rough sketch on paper, and then drew it up in vector, no secret really... and to be honest it isnt perfect at all, but turned out ok.
I guess drawing it at a larger scale then shrinking helped with some of the fine tuning.

Chanakya, whatever your arguments may be but calling the current state of EB2-I a "plight" is a little crazy. We are seeing one of the biggest advancements in PD dates for EB2-I. I can understand if an EB3-I feels outraged after reading your post.
I'm EB2 myself but a little empathy would be a good thing... :)

A lawsuit should bring things back on track. This is what happened in Jul 07. If it was not for the lawsuit dates would not have become current for Jul 07 filers. I feel there is pretty strong case here considering there are so many people who faced the same thing.

The point I am trying to make is that such an action will not be "fair" to people who are in queue (who rely on the 7% cutoff to get their GCs). If the congress makes changes to the rule, then people will have to live with it (fair or otherwise)... by the way, most rules are not made to be fair to everyone. But the thing is such action will have a negative impact on ROW, and it is a pity that many ROW dont realize it. They seem to blindly following IVs call of action. There is some saying about blind faith that escapes me at the moment, but the bottom line is that blind faith is a dangerous thing.
So am I escaping form expounding on my thoughts. Yes, and No. I think I have made succinct argument (based on the laws) as to why things are as such, so I dont see the need to argue further.

After some success in the Senate last year, many of us had become very hopeful and we had high expectations. But things have not gone so well in the past few months.

Dear Friends,
Got Green cards and Welcome notices for me and my wife .
Surprisingly no uscis e-mail and online status is still "initial review"
Our journey in short :
How long in US : 10+ years
First Labor in 2002 . Changed job in three years before approval of labor
Second Labor in 2004 . Approved in 2007
Filed I140 and 485 - in July 2007
Since then I was enjoying EAD / AP with no complain .
I donate to IV now and then , but for some reason only once (for few days) got access to IV-Donor Forum . But always had a faith that IV is doing good work .
From non-donor IV forums and other forums I noticed that USCIS are transferring leftover Visas to other EB categories . I waited to see some thing coming to EB3 but ......nothing came .
My Lawyer told me that I can port to EB2 and it is a normal a process.
1. New Perm
Filed in Feb and approved in 10 days ( Prep work takes 3 to 4 months before filing )
2. EB2 I140 (TSC)
a. Filed in March - Premium Processing
b. My Lawyer sent interfiling letter along with I140 filing
c. Approved in 7 days (A# and Priority Date retained)
d. Same week got Green Cards and Welcome Notices:) - Super-fast Approval
e. No email and no updates on USCIS website
Not sure about the USCIS and Lawyer fees . My company paid for every thing.
Hope every one get the desired freedom asap and don't have to wait like me for 10+ years

My PERM got approved on 07/23/2007 and my attorney is planning to file I-140 and I-485 concurrently by Aug 15, 2007.
I was offered a wage less than the proffered wage till pay period 07/15/2007 and my employer revised my wage to match the proffered wage from pay period 07/31/2007. Hence I would be able to submit 2 paystubs for payperiods 07/31/2007 and 08/15/2007 with I-140 application, which shows that I am currently getting paid the proffered wage.
Please let me know if these 2 paystubs alone are sufficient to demonstrate ability to pay.
We wouldn't be able to submit the employers Quarterly Wage reports with the revised wage as the current quarter ends only on Sep 07.
I understand that USCIS will issue a direct denial without an RFE if the employer is unable to prove atleast one of the following
(1) Net income - The initial evidence reflects that the petitioner’s net income is equal to or greater than the proffered wage
- (Supporting Evidence : Tax Returns).
(2) Net current assets - The initial evidence reflects that the petitioner’s net current assets are equal to or greater than the proffered wage.
- (Supporting Evidence : Audited Financial statement)
(3) Employment of the beneficiary - The record contains credible verifiable evidence that the petitioner not only is employing the beneficiary but also has paid or currently is paying the proffered wage.
- (Supporting Evidence : Annual/Quarterly Wage reports, paystubs)
Ours is a small company and doesn't have net income or net assets matching the proffered wage.

How true! In fact not only we have to maintain H1B to be able to "bring" spouses but we have to MAINTAIN H1B until the our PD becomes current to be able to maintain spouse's H4 status.

Here is my case trail
worked with employer A from June 2005 on h1b visa.
Employer A applied for GC under PERM EB2 with PD - March, 2nd 2006 - labor approved in a couple of weeks
Employer A applied for i 140 in June 2006 and got approved in July 2006
Filed for i 485 in July 2008 never received FP notices
Project got over in last week of February 2008 and unable to find new project.
I switched jobs in last week of April 2008 using EAD - using AC21
Sent AC21 letter to USCIS in July 2008 about job change.
Employer A requested 140 revoke in August 2008.
Spouse got FP notice in August 2008 whereas I (primary) got NOID asking for new employment details.
Responded to NOID in a timely manner and on August 25th, 2008 - my status changed to "Response received - case processing resumed"
In Jan 2009 I got my FP notice.
In Jan 2009 - I travelled using AP and got back fine.
In March 2009 - I got a denial notice saying "485 is denied because 140 was revoked on August 2008. No appeal only MTR" - thisletter comes from a different officer id than the one who sent the NOID.
My question to UN and other gurus. Does it have anything to do with a changed interpretation? My lawyer says "This is a training issue - the new officer did not know about AC21 and as soon as he/she saw 140 as revoked - just ignored your other details on the case and issued a denial notice. This is very common and can be resolved using MTR"
Your lawyer is probably correct. This has to do with IO who are not aware of AC21 laws. But make sure your employer did not have any issues with DOL, USCIS in responding to RFEs related to other employees like H1 RFE, ability to pay , etc which may be used against your application.

Kudos for voicing your opinion !, its upto every individual to choice his/her path, currently their is sheep herding mentality going on (you know what i mean ;)
I have been in this country since 2000, no GC yet, as a matter of fact if my company does not apply for labour in a couple of months , i am sure to go home, my company has said it would apply, but is taking forever. In hindsight, i feel i should have never left India, i have lost on my career development, lost some of my dignity, and feel that i am treated as a 2nd class citizen.
I have decided the GC is for a chosen few ;), not for everybody, I guess i am a coward (whatever that means ?), I prefer to exhuast my H1 and go back Home with some dignity and self respect. It's like this, US is like a mansion (or rather appears to be) , i asked the owner if i could get in, he said OK, i asked the owner if i can stay longer and be here (GC), the owner said he would think about it, now the owner 'OWN's' me, since i have stayed in the mansion for quite long, I am used to the comforts, and not sure if i want to leave or fight the slave trader. I for one, refuse to be labelled, bonded, and treated as 2nd class citizen. I am off to my birth country, and for me its the greatest country, ever on the face of the earth, and i really feel sorry for abandoning it.
Kudos for voicing your opinion !, its upto every individual to choice his/her path, currently their is sheep herding mentality going on (you know what i mean ;)
I have been in this country since 2000, no GC yet, as a matter of fact if my company does not apply for labour in a couple of months , i am sure to go home, my company has said it would apply, but is taking forever. In hindsight, i feel i should have never left India, i have lost on my career development, lost some of my dignity, and feel that i am treated as a 2nd class citizen.
I have decided the GC is for a chosen few ;), not for everybody, I guess i am a coward (whatever that means ?), I prefer to exhuast my H1 and go back Home with some dignity and self respect. It's like this, US is like a mansion (or rather appears to be) , i asked the owner if i could get in, he said OK, i asked the owner if i can stay longer and be here (GC), the owner said he would think about it, now the owner 'OWN's' me, since i have stayed in the mansion for quite long, I am used to the comforts, and not sure if i want to leave or fight the slave trader. I for one, refuse to be labelled, bonded, and treated as 2nd class citizen.
