On March 12, 2002, the House passed such an extension. Section
245(i) of the Immigration and Nationality Act was first enacted as a temporary
provision in 1994 and has been extended several times since then. It enables
unauthorized aliens in the United States who are eligible for immigrant visas based on
family relationships or job skills to become legal permanent residents (LPRs) without
leaving the country, provided they pay an additional fee. Before an alien can apply
to adjust to LPR status, the alien must have an approved immigrant visa petition and
must have a visa number immediately available to him or her. Currently, to be eligible

I've seen dozens of people exploiting sub-labor and got their gc's. There are thousand's of them jumped the queue for last time in July '07. I do agree with the person who started this thread.

On the very first day with the camera, we came home and saw the recorded video to find that she is violently hitting the baby on two separate occasions.
She is of course not going to stay with the baby alone anymore

1) You have evidence of child abuse(video of the nanny severally beating a child in state of new Jersey)

Being a mother of a 9 month old baby i can understand what is going on in u now. First thing i feel is u have to some how get rid of her. I feel u have done a wrong thing first of hiring her. And how can u justify you paying her in cash. So i feel let her go. But then after she left what you should do is in your local websites and ads put up your review and video on her. And that would help another child being treated the way your baby was.
Why i feel that will help is, because i was looking for some kind of care for my baby and i did a 3 months complete survey on what is the right to do. So i am sure any mother will do the same thing in your local area and would come across your video and review.

I called uscis a couple of weeks agoand again today, I was told (by two different resp) that they go by Receipt date.
Of course they go by receipt date, but question is what is the receipt date? Each center enters data, and places folder in sequence of when they, the Center, received the file (and decided to accept it). This date is close to ND, but may be quite different than RD on your receipt, sometimes by several months (due to noone accepting huge volumes of July/Aug07 filings, or for some reason disputing as to which center should work on the case).
There are thousands of instances where cases were filed in July 07, but entered into the system in Sept/Oct 07. For all purposes, their RD is what you see online as "your case was received on...", which is close to ND.

can pre adjudicated files also be sent to review or is it only to files that are not pre-adjudicated but are trying to pre-adjudicate
the biggest stress is the window of opportunity is so small that the stress levels are going to be high. if not now then we have to wait for another year. for the first time in my life I can see why our elders used to give up on government activities and why they say have patience. here with uscis it seems like years are passing by like eons but uscis asks us to consider them as minutes or seconds.
one of the ridiculous person at uscis when asked why i am not getting my ead in 90 days says this - sir there are people still waiting from a year to get their green card so please have patience and consider yourself lucky that it is just 90 days. what kidn of a screwed up person give such a response.
seems like we have to go through this painful month once again. lucky people will get their green card - unfortunate ones will have to wait for however long it is

Well, that may not be quite correct. Service centers claim that they process cases in order they receive them. Receive Date on the receipt is the official RD (the mail room receive date) by USCIS. It is not the date case was received by a center. In the above case, files were just waiting somewhere between Aug 17 and Oct 16. Texas center perhaps opened the case on Oct 16, entered it in the system and sent out a notice. Online status perhaps shows "...your case was received on Oct 16...". So, as far as Texas center is concerned they received the case on Oct. 16.
Thus, as curent processing times are at August 23, 2007, dwhuser case file is yet to be opened. Since file is not yet opened, no one yet knows his/her PD (it is nowhere other than on paper files). So the case waits - his/her PD may get current and pass. Of course, Aug 17 '07 to Oct 16, '07, was not dwhuser's fault, but it put him/her behind a lot of cases whose files were accepted/opened by a center in the meantime.
