The company I am working with doing business for 40 years (less than 40 employee) and as per my lawyer, financially very good. I hired the lawyer and employer directly gave him financial docs. I am only one person with H-1 in this company's history and working for 4 years. Got labor approval on PERM EB2 (MS+1) and did concurrent filing with I-140 premium processing.
I received RFE regarding company's ability to pay. We sent tax files for FY 2005 (contains oct '05 to Oct '06) for being PD of Nov '06 and W2 for 2006 which showed 6k more than offered wage. Company started paying me offered wage one week after the PD and offered wage is 3k more than prevailing wage. RFE specified to show ability to pay by showing 2006 tax return or audited financial statement by 12 weeks. Any of this will not work as tax file will be prepred on Nov '07 for FY 2006 and audited finan. stat. costs a lot of money. My company has no clue and just planning to write a letter that they will not able to provide before Nov 07 and already submitted tax file upto Oct 06 which could be enough to find the financial status. They talk to their CPA and he advised to do so.
I am really not very fimilar with all these issues. What should I do as company is not able to provide above 2 things that USCIS asked for? Can I send my paychecks even started getting paid offered wage after one week?

I do think a lot of times that Hillary has a better handle of issues and she is very articulate. Billary (yes Billary) concerns me. I think it is going to be tough to be just Hillary and not Billary.She had a good answer for it last night but it is hard beleive there will be no Billary. Even while we all suffer due to the retrogression, most of which is out of our control, I believe we can still remain positive in areas over which we do have control, like our sense of humor and ability to get along with everyone by agreeing to disagree in a civil manner. Unfortunately this forum of so called "highly skilled" sorely lacks it. Every disagreement/debate becomes personal and quickly dissolves into a shouting match. It's really sad. We need to learn to be happy for others who are more fortunate and sympathize with others who are less fortunate. We don't have to be highly skilled to be that...just human.

I don't think my company will spare the time and money to prepare audited financials.

IV is already not member friendly. With 25,000 members, raising 30,000 is getting so difficult. Why so? I once posed the question and moderators conveniently deleted it.

Just wondering why USCIS is neither accepting nor rejecting the July 2nd application? How long can thy hold applications like this? Can they leverage this in their favour in the class action lawsuit? Is this procrastination deliberate , considering its legal implications?

From what I understand, once the law comes in to affect, labor substitution will no longer be allowed so desi companies can't sell labors anymore. But the 2nd part of the puzzle was that approved labor will only be valid for X number of days (like 45 days as originally proposed) and I am not sure if this impacts the existing labors or not. 45 days expiration may only apply to new labors but no details has emerged yet so we'll have wait and see when the details come out. If it also applies to existing labors then we are home free because after the expiry date, all labors will automatically be canceled. Well, let's wait the for the fine details to come out first.
If this law does not apply to existing labors, we will still be in the same situation. BTW, what is a desi company. How come it can sell labors? Is selling labor legal?

I read through the bill but don't quite understand...if I am working for a client on H1B, will I need to stop working as soon as this bill takes effect? or it only applies to newly applied H1B's (or extension/transfer)?
Yes, that is my understanding at this point based on the language . As soon as the bill goes into effect, you will need to stop working at the client site if the bill passes in its current form AND you are working as a FT employee (w-2) of a mere placement company (aka agent or desi consulting). If you are an FT employee of big consulting company then until they get waiver for you AND your current client proves that no layoffs were done at the client site in the last 180 days, you will need to stop working.
