I was trying to figure out all these greens and reds... How does one get them.... and the mouse on the green squares to the right say stuff like "distinguished road", "Aura", "jewel on the rough" etc... what does this mean?

Story in brief: I came to the US in August 1999 on a F-1 visa to pursue my
Masters in Civil Engineering at XXX University. Prior to coming here, I had four years of experience in the civil engineering field. It is important to note that I came to the US with funding from XXX University in the form of partial tuition waiver and assistantship. My research was also funded by the XXX Department of Transportation. While I was completing my MS, my wife who also is a BE (Civil) from India, started to pursue her goal of obtaining a BS in Computer Science. I graduated in 2001 and started working in the office where I am currently employed. My wife graduated in 2003 with a BS with Distinction in Comp. Sci. We were full of hopes that with a distinction, getting a job in her field would be easy and that is where the bubble burst. Repeatedly she was told by many companies in the state of XXX that they do not hire international students or sponsor their work visas so she should "try" again when she recives her permanent residency! And this while we knew people these companies brought in on contract basis to do the work, people like my wife with no experience. Anyways, my wife is now so depressed and frustrated that I am worried about her health. Imagine having a BS in a top notch field but not getting a job because companies won't hire or sponsor internationals!!
In the meantime, I have been working on significant transportation related jobs (designing foundations, slopes and soil engineering for highways and interstates) for projects funded by the Federal Highway Administration and the Department of Transportation. In the last five years, the total construction cost of the highways in which I have been involved in easily exceeds USD 350 million dollars!! And the best part is that I am the only geotechnical engineer in the XXX state office. I believe that I have certainly paid the taxpayers of the state of XXX back the faith they had shown in me when the University (it is a public university) decided to fund my education by staying and working in the State of XXX and utilizing the education and experience gained to make lives better for the people of the state of XXX by being involved in designing safer, faster roads at the best possible cost.
Currently, my labor was filed under PERM in April 2006. I will be in the EB3
category, subject to retrogression and my wife will not be able to work for
another 7/8 years, by which time she will most likely have lost the
competitive edge and enthusiasm.

How can there be RD/NDs of 2008 as far as I remember only 15 or 30 days of July were open for filing I-485 after that dates had retrogressed......

ya, lets step-up a poll and have everyone vote, as if this is the US congress. And after voting leave it for someone else to work on this and other "brilliant" idea. There needs to be a reality check. This poll doesn't mean anything unless there are enough people to spend time and energy at every level. But ya, lets setup a poll and have everyone vote, it will give everyone a feel good factor that everyone contributed in the advocacy effort, how? by voting in the pool and not doing anything about how everyone votes.

As I had mentioned earlier, do not be under the misconception that just because you are working in a stable cash-rich comany and happy with your job, it can't get bad. Your company can move, downsize, close a branch or just fire you....given the current scenario, it will take atleast 5/6 years (if you are lucky and maybe more if you are unfortunate) to get a GC and all these years can go waste by any of the above happening

I have lived in USA for 6 years - legally paying my taxes, following all the laws and contributing to the society to the best of my abilities. I am currently on H1-B visa extension.
My wife is working for a company on H1-B. Her employer promised in mid-2005 that she would start the GC process for her so that we could have a backup. Till now her GC has not been started. My wife is in a dilemma of whether she should quit her job and join somewhere else. But if she does move to a new company, even they will not start her GC process immediately. Even if they do what is the point because of retrogression?
With the retrogression my GC could take years....sometimes I wonder if the stress, living in constant fear not knowing what is going to happen tomorrow, staying far away from loved ones, all these sacrifices is really worth it when legal workers like me who have contributed to the economy of America seem to have no value in this country.

Please DO NOT post the video on Youtube. I fail to understand what good is the video going to do - its another matter to post the nanny's pics and probably on Sulekha or other sites - I'm still not able to convince myself if that will be required now that law authorities are involved - but the idea to post the actual video - what the hell is this - dont know what folks were thinking when they asked you to do so.

Well said. Just think of this flower drive as a way to display our collective might to the media. What really shocks me is that most of us are tech savvy and yet we don't even see too many blog posts on this issue by the community of skilled, legal non-immigrants.
We need to be more vocal, and sending flowers is just another way of expressing our thoughts.

Even one year after July 07 bulletin, the State Department is saying that USCIS is not estimating accurately. Where is the question of estimates, they should look at ACTUAL data.
And where is IV management? Yes, people should work with their state chapters.....but now is the time for the core IV group to wake up and take up the fight with the higher ups in the goverment. Show them how the State Department + USCIS is treating immigrants because of their lethargy and laziness.
I think state department has made a mistake by writing that USCIS can not estimate (in the latest bulletin) and we should take full advantage of it. Complain-Complain-Complain, make them look bad, and in this election year they may act on it...........

I guess My interview didn't go as expected.
1) I reached the office an hour early.
2) After waiting,they did security check and let us in
3) Then the lady who was assigned my case, came and took us into her room
4) Oath, etc
5) She then started asking for Birth cert, Marriage Cert, kids birth certi, 140 approval copy.
6) Then she pulled a file (which was labelled DOS Visa bulletins) and spent around 15 mins on Oct 2007 bulletin.
7) Then asked us who filed your 485..you did your self or your employer did..we said employer.
8) Then she said, something is not right..per Oct 2007 bulleting Visa's are unavailable so yours was not filed properly.
9) Then I said, ours was filed in Aug 8th 2007. She insisted the receipt date is oct 2007..then we showed her our 485 reciept.
10) Then she thanked us and started looking at Aug 2007 visa bulletin. and said, even then in Aug 2007 EB2 was U, so yours was not properly filed.
11) I told her, There was an interim Memo released by USCIS that they will accept application until Aug-17 2007 based on July 2007 visa bulletin
12) She said she will look at DOS bulletins
13) After 10 mins she said, she cant find any such memo..and said, since there is no evidence with her, she has to deny our case based on "Improper filing when PD was not current"
14) Then I said, if PD was not current, wouldn't TSC return the application denying on the spot? Why would they accept the application?
15) She said, you would think so..but they accept many times..so we are told to verify all the time
16) THen said, she believes us but for process, she needs evidence and said she will look into further and then make a judgment.
17) We had no choice and we were over the interview. we were little disappointed though
18) After coming home, I realized she took all I-94s and we got panicked..because if 485 is getting denied and I-94s are gone, how do we prove our legal status, so we thought of going back..then I thought, if have to go anyway, then I should take a print out of Interim Memo
19) I went back an hour later with the print out
20) I told security that, we had finished our interview and officer forgot to return our I-94..they insisted that we shud take infopass and they wont allow anyone to go back..I had to really argue with them (I decided I have nothing to loose..anyway 485 is screwed and so stood there asking them to let me in)
21) After consistent nagging, the security guy took our passports, interview response letter(After interview if your app doesn't get appproved they willgive a kind of reciept saying u attended the interview..blahblah) and went in

23) I went inside, and after a while officer came back. We apologized and told her that we came back for I-94s..she said they will retain and wont return..We told her that we are not using EAD and we are still on H1B..she said she will give back..

25) She read that and said I am glad you came back..this clears everything out..I will run this by my supervisor and will see if we can adjust status today

28) Then she looked into the computer to get the visa #.
29) The we noticed a changed in her face and then she quickly turned into a folder of current VISA bulletin..we said..oh..no..not again.
30) The officer said, per visa bulletin u r current and ur PD is dec 2005..there is no reason for system not to allocated a visa #..
31)She tried for 10-15 mins and finally gave up..said she cant stamp in the passport without allotting the visa number..said sorry..I cant do anything..I will follow up with DOS ppl and will let you know in a week or so.

WTF..... i'm so damn ticked off now.
Eb3-I has been just hung out to dry.
Everything else keeps progressing. Bullshit obama govt isn't doing squat for the immig reform bill too.
I'm fine with Eb2-I progressing, but shouldn't there be something to move Eb3 too. Its crazy to think that folks in Eb3 with dates of 2002/03 are still waiting while Eb3 folks from 2005 are now current.

This idea will just put another layer on the GC process. If you are going to make a rule/law to allow this 5 year EAD and new status, why not instead change the LAW to allow higher numbers of yearly GC cards or remove the country based limits.

For us, life revolves around everything immigration. For IOs, its just a job to pay the bills. I wouldnt fault the IO...they are just doing their job & acting according to procedure. How many of us professionals keep track of EVERY SINGLE thing thats related to our industry. So keep that in mind while we criticize USCIS people.
If the company I work at, filed an intellectual bankrupcy and had become a big issue that I have to encounter in my day to day life, I would definitely remember that.
